Terms of service

These terms apply to your use of this store and to anything you buy from us. By placing an order you accept them. The store is operated by KYVA Performance, ABN 79 776 482 747, of 9 Lawson Street, Southport, Queensland 4215, Australia.

Using the store

You must be at least 18, or have permission from a parent or guardian, to buy from us. You agree not to use the store for anything unlawful, and not to copy, scrape or resell our content without our permission.

Products

We do our best to show our products accurately, but colours and finishes can look different on different screens. Product images are illustrative.

KYVA nasal strips are a general wellbeing product. They are not a medical device and are not intended to diagnose, treat, cure or prevent any disease or condition. They are for external use only. Do not use them on irritated or sunburned skin, stop use if irritation occurs, and keep them out of reach of children. If you have a medical condition affecting your breathing, speak to a health professional rather than relying on a nasal strip.

Orders and pricing

All prices are in Australian dollars and include GST where it applies. We try to keep pricing and stock accurate, but errors happen. If we find a genuine pricing or stock error on your order we will contact you and give you the choice of continuing at the correct price or getting a full refund. We may refuse or cancel any order, and we will refund you in full if we do.

A contract is formed when we dispatch your order, not when you place it.

Shipping and returns

Our shipping policy and returns policy form part of these terms.

Your account and information

You are responsible for the accuracy of the details you give us, including your delivery address, and for keeping any account login secure.

Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. Subject to that, our liability for any claim relating to a product is limited to replacing the product or refunding what you paid for it.

Changes

We may update these terms. The version published at the time you place your order is the version that applies to that order.

Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that state.
